Effective from 25 October 2026.
This is a translation for your information. The Czech version is legally binding.
1.1. These terms govern the relationship between the provider of the Sojka service, MYPIXEL s.r.o., company ID 17617421, registered office Příčná 1892/4, Nové Město, 110 00 Praha 1, Czech Republic, registered in the Commercial Register kept by the Municipal Court in Prague, section C, file 373971 (the “Provider”), and the customer using the service (the “Customer”).
1.2. Sojka is an online service (SaaS) that runs a chat with an AI assistant on the Customer’s website. The assistant answers website visitors based on the content of the Customer’s web pages and documents and on additional information the Customer enters in the admin.
1.3. The service is intended for businesses and other legal entities such as towns, schools and associations. The Customer uses it for its business or public tasks, not as a consumer.
1.4. The contract is concluded when the Customer confirms the order or pays the first period. These terms and the data processing agreement form part of the contract.
1.5. As this is a contract between businesses, the Customer has no right to withdraw within the 14-day period that the law grants to consumers. The contract may be terminated under Article 12.
2.1. The Provider sets up the account at the Customer’s request. The Customer receives login details to the admin.
2.2. The Customer provides true information and keeps its contact e-mail up to date. A message sent by the Provider to this e-mail is deemed delivered.
2.3. The Customer protects its login details against misuse. The Customer is responsible for activity under its account unless caused by a failure on the Provider’s side.
2.4. The Provider’s staff may access the account for support, setup or troubleshooting. Every such access is logged.
3.1. Before publishing, the Customer may try the assistant in the admin preview for up to 10 answers.
3.2. By publishing the assistant on the website the Customer places a binding order for the chosen plan and period. The assistant starts working immediately and the Provider issues an invoice.
3.3. Where the Provider arranges the service with the Customer personally, it may offer a trial in another way. The terms are then stated in the offer.
4.1. The service is provided in plans with a fixed monthly price:
| Plan | Price per month | Answers included |
|---|---|---|
| Start | 349 CZK | 200 |
| Standard | 549 CZK | 500 |
| Unlimited | 749 CZK | unlimited |
4.2. An answer means one reply of the assistant to a website visitor. Answers in the preview, answers that failed due to an error and questions refused due to the limits under Article 6 do not count towards the plan.
4.3. If the Customer exceeds the number of answers in its plan in a month, it pays nothing extra and the assistant keeps answering. If this recurs, the Provider recommends a higher plan. The plan changes only with the Customer’s consent.
4.4. The Provider is not registered for VAT; prices are final. Installation and setup are not charged separately.
4.5. Individual terms may be agreed and take precedence over this Article.
4.6. The Customer sees the number of answers for the current month in the Usage section of the admin.
4.7. The Provider may change the plans, for example their price, the number of answers included or introduce a limit on the unlimited plan. It announces the change by e-mail at least 14 days before the next billing period begins. The change applies only from that period, never retroactively. If the Customer does not terminate the contract before the period begins, it is deemed to agree with the change.
5.1. The service is paid in advance for the chosen period: a month (card only), half a year or a year (card or invoice). For a year the Customer pays 11 months.
5.2. With card payment the subscription renews automatically at the end of the period and the payment is charged to the same card. The Customer may switch off renewal at any time in the admin or by e-mail; the service then runs until the end of the paid period.
5.3. The invoice for the first period is issued when the assistant is published and is due on the date of issue. The invoice for the next period is issued 14 days before the current one ends and is due on its last day.
5.4. If a payment fails, the Provider notifies the Customer by e-mail and retries the card payment. Meanwhile the assistant keeps answering. It is switched off at the latest 4 days after the due date and switched on again after payment.
5.5. A paid period is not refunded, except where the Customer could not use the service through the Provider’s fault.
6.1. In addition to the plan, each assistant has a protective monthly answer limit, well above normal traffic, which protects against abuse such as a bot attack. Once reached, the assistant shows an apology instead of answers until the end of the month. The Provider raises the limit at the Customer’s request and notifies the Customer by e-mail when it is reached.
6.2. The Customer may set a daily answer limit per visitor device. The Provider may also limit the number of messages from one device or address within a short time where necessary to protect the service.
6.3. Limits are tied to the device and browser and the Provider does not guarantee they cannot be circumvented.
7.1. The Customer uses the service in accordance with the law and these terms.
7.2. The Customer is responsible for the content of the website, documents and additional information the assistant uses and for holding the rights needed to use them.
7.3. The Customer informs visitors to its website about the processing of personal data in the chat. A sample text is provided in the help.
7.4. The Customer must not use the service to spread unlawful or misleading content, to circumvent prices and limits, for load or security testing, to copy the service or otherwise in a way that endangers its operation.
7.5. The assistant is not intended to collect special categories of personal data (e.g. health data). The Customer must not configure it to do so.
8.1. The Provider operates the service with professional care and strives for the highest possible availability. It does not guarantee uninterrupted availability.
8.2. The Provider may perform maintenance and updates. Planned maintenance that may significantly limit operation is announced in advance. In a security incident or other emergency, the Provider may intervene without notice.
8.3. The Provider may develop the service and change its technical solution as long as the agreed functions are not substantially impaired.
8.4. The Provider uses third-party services, in particular hosting, a database and language models. They are listed in the list of subprocessors.
9.1. Answers are generated by artificial intelligence and may be inaccurate, incomplete or outdated. The chat tells visitors so.
9.2. Answers are for information only. The Provider is not liable for decisions made on their basis. The Customer can review answers in the conversation overview and add missing information.
10.1. When running the chat, the Provider processes visitors’ personal data on behalf of the Customer as a processor under Article 28 GDPR. The data processing agreement (/en/dpa) forms part of the contract.
10.2. The Provider processes personal data of the Customer and its staff as a controller according to the privacy policy (/en/privacy).
11.1. Rights to the service, its code, design and the Sojka brand belong to the Provider. The Customer receives a non-exclusive, non-transferable right to use the service for the term of the contract.
11.2. The Customer’s website content and documents remain the Customer’s. The Customer grants the Provider the right to load, store and process this content to the extent necessary to run the service.
12.1. The Customer may terminate the contract at any time by e-mail to sojka@sojkachat.cz or in the admin under My account. The service runs until the end of the paid period; at the Customer’s request we switch it off immediately.
12.2. The Provider may terminate the contract by e-mail with 30 days’ notice. It may terminate immediately or suspend the service in the event of a material breach of these terms, a breach of the law or a threat to the security of the service.
12.3. Within 30 days of termination the Provider deletes the account, settings, content and conversations. The Customer may download them in the admin beforehand. Data required for accounting is kept for the period required by law.
13.1. The Provider is not liable for lost profit or indirect damage, nor for outages caused by force majeure or third-party providers that it could not reasonably influence.
13.2. The Provider’s total liability is limited to the amount the Customer paid for the service in the last 12 months. The limitation does not apply where the law does not permit it.
14.1. The contract is governed by Czech law. Disputes are decided by the courts of the Czech Republic.
14.2. The Provider may change these terms and will announce a change by e-mail at least 30 days before it takes effect. If the Customer disagrees, it may terminate the contract by the effective date; otherwise the Customer is deemed to agree.
14.3. If any provision is invalid, the remaining provisions remain in force.
14.4. These terms are issued in Czech. Translations are for information only; the Czech version prevails.
